How to Appeal a Denied Tyson Workers’ Compensation Claim*

Tyson Foods is one of the world’s largest food exporters, principally meat and meat products. If you work for Tyson, or any other food exporter, there are workplace hazards that are unique to the industry.

If you are involved in an accident and are injured, you will have probably already filed a workers’ compensation claim.

Quite often, a claim is denied for very simple reasons. Once a mistake has been discovered at some point in the claim procedure, your original claim may be reactivated again.

If the disputed claim cannot be resolved easily, you have the option of filing an appeal. At this stage it is important to have legal representation.

Contact The Insurance Company

You should receive a formal notification from the insurer confirming their decision to either accept or deny a workers’ compensation claim. There may be no reason given if the claim is denied.

If this is what you have experienced the first step will be to contact the insurer directly to find out why your claim was unacceptable. It may have been because your employer didn’t inform them, or got the dates wrong.

It sounds unlikely but in fact many denied claims are due to incorrect information being passed on. There may be a dispute about the amount claimed, but workers’ comp. is a no-fault type of insurance.

Unless you were intoxicated or tried to injure yourself deliberately, you don’t have to prove that you were not at fault.

File Your Tyson Workers’ Comp. Appeal

If you cannot convince Tyson’s insurer to reverse their decision to deny your claim for compensation, the next step is to file an official appeal with the state agency responsible for workers’ compensation.

This is not a step to be taken lightly and you should have legal advice before filing an appeal. Like the earlier part of filing a claim for workers’ comp. the appeal procedure is quite strictly regulated.

You may be asked to attend a mediation session first to see if the disputed clam can be resolved without having to schedule a formal administrative hearing.

Mediation tends to be more informal, but it is sensible to have your lawyer present at the meeting to help represent you.

If mediation is unsuccessful, a full hearing will be arranged with a judge, or panel of adjudicators who decide the fate of your appeal on examination of all the evidence for or against your claim.

There are further steps that you can take in the appeal process even if the hearing ends in a negative decision.

A Workers’ Compensation Attorney Can Help File an Appeal

An appeal against a denied workers’ comp. claim is not easy. It is also quite long winded and could take months before a decision is finally made.

You are advised to have legal representation in the form of a workers’ comp. lawyer to guide you through the process.
